1. GENERAL PROVISIONS

 

This website is owned by ZOLOTCO BAKERY SRL. By placing an order in the online store, the Buyer accepts the Terms and Conditions for the sale of goods/products and/or the provision of services, which are based on the legislation of the Republic of Moldova (hereinafter the “Terms and Conditions”) set out below. Use of the website implies acceptance of the Terms and Conditions proposed by ZOLOTCO BAKERY SRL, in accordance with Law No. 284/2004 on Electronic Commerce. The relationship between the client and the seller is governed by Law No. 105/2003 on Consumer Rights Protection and other normative acts adopted in accordance with it. The Seller reserves the right to amend these Terms and Conditions, and the Buyer is obliged to monitor any changes.

 

 

2. PERSONAL DATA PROTECTION

 

By using the buna.md website, you automatically agree to the collection and processing of personal data necessary for processing/confirming/fulfilling orders. Personal data is processed only for legitimate purposes, such as providing the products you order, promotions, Google Analytics, cookies, and notifications/newsletters. All information containing personal data is stored and used only for the period necessary to achieve the purposes for which it was collected, and in accordance with Law No. 133/2011 on the protection of personal data. We use commercially reasonable security measures to prevent unauthorized access, maintain data accuracy, and ensure the proper use of the information on the website. Data transmission over the internet or a wireless network cannot be fully secured. Therefore, like other companies, we cannot guarantee the security of the information provided by the Buyer, and the Buyer does so at their own risk.

 

 

3. ORDER PLACEMENT AND PAYMENT

 

Orders can be paid by payment card. Upon receiving your order, you will receive a fiscal receipt confirming the payment. Online payment is made under maximum security conditions using a payment card, which allows online transactions. After the payment is completed, you will receive a payment confirmation at your email address. The payment processor uses a secure system based on the latest version of the 3D Secure security standard, which represents a new global approach to authenticating buyers in secure online transactions. This security measure involves redirecting the user, at the time of payment, to a secure maib page where each cardholder is authenticated by assigning a one-time code for each online transaction. Refunds are issued only to the payment card used for the purchase. To make a payment, you will need to enter your bank card details. The transfer of this information is carried out in accordance with all necessary security measures. The information is transmitted in encrypted form and stored only on a specialized server of the payment system. The following data will be required to complete the payment: Card number (16 digits); Expiration date (month and year); CVC or CVV code (3 digits); Cardholder first and last name. If the card currency differs from the transaction currency (MDL), then the issuing bank’s conditions will apply when converting the amount debited from the card account.

 

 

4. DELIVERY OF PRODUCTS / GOODS / SERVICES

 

After an order is placed, the Buyer is provided with information on the estimated delivery date by the couriers/delivery service. Delivery within Chișinău is carried out within 48 hours from the time our operators confirm the order. Delivery fee: 50 MDL. Delivery to the rest of the country is carried out within 72 hours from the time our operators confirm the order. Delivery fee: 50 MDL. No deliveries are made on Sundays or on national holidays. The delivery time may be extended in certain isolated situations (for example: unfavorable weather conditions, public holiday periods, unforeseen technical issues, etc.). We will notify you in advance if we encounter such a situation. You may choose any delivery address (home, office, or any other address) at no additional cost. We accept only one delivery address per order. If you need the order delivered to different addresses, please place separate orders for each address. Upon receiving the products, please, in the presence of the courier, check the integrity of the packaging and the presence of the fiscal receipt. Any later claims regarding these aspects will not be accepted.

 

 

5. RIGHT OF RETURN

 

According to Law No. 105-XV of 13 March 2013 on consumer protection, the Buyer has the right to return the purchased product/goods for certain reasons within 14 days from the date of payment. The funds are refunded to the card used for the purchase. Freshly prepared products cannot be exchanged or returned, in accordance with Annex No. 2 to Government Decision No. 1465 of 08.12.2003 (MO248-253/19.12.2003), as amended by Government Decision No. 1188 of 02.11.2007 (MO175/09.11.2007). 6. PRIVACY POLICY

 

In accordance with Law No. 133/2011 on the protection of personal data, the service provider processes personal data. Personal data is processed in good faith, on a legal basis and in compliance with legal provisions. Personal data processing is carried out using mixed methods (automated and manual), in accordance with legal requirements and under conditions that ensure security, confidentiality, and respect for the rights of the data subjects. The provider collects and processes only the personal data supplied by consumers when placing an order: first name, last name, phone number, address, postal address. Personal data is used exclusively for administering the website, enabling access to specific information, delivering orders, or contacting the consumer in order to fulfill delivery. Through this notice, users and consumers acknowledge that their personal data (first name, last name, phone number, address, postal address) will be processed and used. The service provider processes the personal data of users and consumers provided through browsing, using, and registering on the .md website. Any information provided by the users and consumers of the .md website will be considered and will represent explicit consent for the Provider to use personal data. The Provider will not disclose any of the data it holds to third parties without the consent of the data subjects and will not sell, exchange, or disclose this data to other persons, except as required by applicable law (at the request of state public institutions, law enforcement bodies, courts, which are also authorized to process personal data). Personal data may also be processed and used by the Provider for statistical purposes and for subsequent promotion. The service provider meets personal data security requirements, ensures the protection of consumers’ data, and protects it from being lost, destroyed, altered/forged, or disclosed to third parties. The provider’s employees are obliged to maintain the confidentiality of consumers’ personal data. Personal data will be processed by the Provider’s authorized person. The Provider uses security methods and technologies in accordance with the applicable legal provisions. The Provider does not collect information related to transactions, such as card number, expiration date, country of origin.
